What is an exclusive agreement
An exclusive agreement grants a single real estate agent the sole right to market and sell your property for a specified period. Under Israeli law, the exclusivity period for apartments is limited to six months, while for other properties, it can extend up to one year.
This arrangement ensures that your property receives focused attention and dedicated marketing efforts. The agent is obligated to actively promote your property, provide regular updates, and adhere to agreed-upon marketing strategies.
It is important to note that you retain the right to cancel the agrement if the agent fails to perform as stipulated, such as not advertising your property within the first two months. However, if the agent fulfills the obligations, the agreement remains valid for the full term and can be renewed by mutual consent.
If I find a buyer, seller, or tenant myself during the exclusivity period, do I still have to pay the agent?
Yes. According to Israeli real estate regulations, if the agent fulfills their contractual obligations, actively marketing your property and providing professional service, they are entitled to their commission even if you personally bring the buyer, seller or tenant.
This is because the agent’s advertising and efforts create the opportunity that leads to the transaction. The law protects the agent’s right to commission for any deal that closes during the exclusivity period, regardless of who makes the introduction.

IF the other party has their own agent, how is the commission handled?
Each agent usually receives their commission from their own client. So whether it’s the buyer or seller who has an agent, each pays their own representative.

Why can't I work with multiple agents without an exclusive agreement?
Working with multiple agents might seem like a good way to increase your chance, but it often leads to confusion, mixed messages, and missed opportunities.

How much do i have to pay, and when is the payment due?
For rental agreements, the typical commission is one month’s rent.
For sales or purchases, the standard commission is around 2% of the contractual sale price.
The agent is entitled to payment as soon as a binding contract is signed. Even if the contract is later revoked for any reason, the agent retains the right to their commission, provided the transaction occurs during the exclusivity agreement period, or if there isn’t one, provided they were the effective factor in bringing about the agreement,
However, if the contract is revoked due to the agent’s lack of transparency, misrepresentation, or fraudulent behaviour, the agent may lose the right to their commission under the Israeli Law.
